Overview — Welcome to the Bappies Family

We know. You came for thoughtful care, not a bedtime story about billing information. We’ll do our best to keep this readable.

Welcome to Bappies®! Throughout these Terms, “we,” “us,” and “our” refer to Bappies. We operate this website and store, including its information, content, features, tools, products, and services, collectively called the “Services.”

Our store is powered by Shopify, which provides the platform that helps us bring Bappies to you.

These Terms of Service, together with the policies referenced here, explain your rights and responsibilities when using the Services. We refer to them as the “Terms.”

Please read them carefully, particularly the sections covering warranties, liability, and your responsibilities.

By visiting, interacting with, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and Your Account

The little ones inspire our products. The account and checkout responsibilities belong to the grown-ups.

By agreeing to these Terms, you confirm that you are at least the age of majority in your state or province of residence. If you allow your minor dependents to use the Services on devices you own, purchase, or manage, you consent to their use.

You may need to provide information such as your email address, billing address, payment details, and shipping address to use certain features or place an order.

You confirm that the information you provide is accurate, current, and complete, and that you have the right to provide it.

You are responsible for keeping your account credentials secure and for all activity under your account. You may not transfer, sell, assign, or license your account to another person.

2. Our Products

We work to show our products accurately, including their descriptions, colors, and photographs. However, screens and device settings can affect how a product looks online.

We do not warrant that a product’s appearance or quality will meet your individual expectations or look exactly as it appears on your screen.

We may update product descriptions or discontinue products at any time, without notice, at our discretion. We may also limit quantities offered to particular people, geographic regions, or jurisdictions on a case-by-case basis.

3. Orders

Before submitting your order, give the details one last look. A quick check now can save a little inbox time later.

Placing an order is an offer to purchase. We may accept or decline an order at our discretion. An order is not accepted until we confirm acceptance, and we must receive and process payment before accepting it.

We may be unable to accommodate cancellation requests after an order has been accepted.

If we decline, change, or cancel an order, we will attempt to notify you using the email address, billing address, or phone number provided with that order.

Returns and exchanges are governed by our Refund Policy.

You confirm that purchases through this store are for your personal or household use and not for commercial resale or export.

4. Prices and Billing

Prices, discounts, and promotions may change without notice. The price charged will be the price in effect when you place your order, as shown in your order confirmation email.

Unless we expressly state otherwise, posted prices do not include taxes, shipping, handling, customs duties, or import charges.

Prices in our store may differ from those offered by physical retailers or other online sellers.

Some promotions have separate terms. If those terms conflict with these Terms, the promotion’s terms will apply to that promotion.

Please provide accurate, complete, and current purchase, payment, and account information. Update your details promptly so we can process your transactions and contact you when needed.

By submitting payment information, you confirm that:

  • The information is accurate and complete.

  • You are authorized to use the payment card.

  • Your card issuer will honor the charges.

  • You will pay the posted price and any applicable shipping, handling, and tax charges.

5. Shipping and Delivery

Title and risk of loss pass to you when we hand your shipment over to the carrier.

We offer optional package protection through Route, which can be purchased at checkout. We recommend considering this option for additional peace of mind.

If an order arrives damaged, contains the wrong item, or has another delivery issue, please follow the instructions in our Refund Policy and contact hello@bappies.com.

6. Intellectual Property

We’re happy to share our products with your family. Our logo and website content still need permission before they go on adventures of their own.

The Services—including trademarks, brand names, text, displays, images, graphics, product reviews, video, audio, and their design, selection, and arrangement—are owned by Bappies, its affiliates, or its licensors. They are protected by applicable U.S. and international intellectual property laws.

These Terms allow you to use the Services for personal, noncommercial purposes only.

Without our prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit material from the Services.

Except as expressly stated in these Terms, no license or other intellectual property rights are granted to you. Unauthorized use may violate applicable law. Bappies reserves all rights not expressly granted.

Bappies’ names, logos, product and service names, designs, and slogans are trademarks of Bappies, its affiliates, or its licensors. You may not use them without prior written permission.

Shopify’s names, logos, product and service names, designs, and slogans belong to Shopify. Other trademarks appearing on the Services belong to their respective owners.

7. Optional Tools

Some features may use tools provided by third parties. We do not monitor those tools or control their operation.

We provide access to these tools “as is” and “as available,” without warranties, representations, conditions, or endorsements of any kind. We have no liability arising from or relating to your use of optional third-party tools.

You use these tools at your own discretion and risk. Please review and understand the relevant provider’s terms before using them.

We may introduce new features, tools, or resources in the future. Those additions will also be subject to these Terms.

8. Links to Other Websites

The Services may contain third-party materials, embedded features, or links to websites operated by others.

We are not responsible for examining or evaluating the content or accuracy of those materials or websites. If you leave our Services to access them, you do so at your own risk.

We are not liable for harm or damages related to your access to third-party websites or your purchase or use of their products, services, resources, or content.

Please review the relevant third party’s policies before using its services or making a purchase. Questions, complaints, or claims about third-party products or services should be directed to that provider.

9. Our Relationship With Shopify

Shopify provides the platform that powers our store. Your purchases, however, are made directly with Bappies.

By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Bappies, including injury, damage, or loss resulting from purchased products or services.

You expressly release Shopify and its affiliates from claims, damages, and liabilities arising from or related to your purchases and transactions with Bappies.

10. Your Privacy

Our collection and use of personal information are described in our Privacy Policy. Certain personal information may also be subject to Shopify’s Privacy Policy.

By using the Services, you acknowledge that you have read these policies.

Because Shopify hosts our store, it collects and processes information about your access to and use of the Services to provide and improve them.

Information you submit may be transmitted to Shopify and other third parties, including parties located outside your country of residence, to provide services to you.

11. Reviews, Ideas, and Other Feedback

We appreciate hearing from you. Whether it’s a thoughtful suggestion or an enthusiastic account of laundry day, please keep it honest and respectful.

If you submit ideas, suggestions, reviews, proposals, plans, or other content, collectively called “Feedback,” you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute, and display it in any medium for any purpose, including commercial purposes.

We may use Feedback to operate, evaluate, improve, and promote the Services, and to fulfill our obligations or exercise our rights under these Terms.

By submitting Feedback, you confirm that:

  • You own it or have all necessary rights to submit it.

  • You have disclosed any compensation or incentives connected with it.

  • It complies with these Terms.

We are not obligated to keep Feedback confidential, compensate you for it, or respond to it.

We may, but are not required to, monitor, edit, or remove Feedback that we determine is unlawful, offensive, threatening, defamatory, pornographic, obscene, otherwise objectionable, or in violation of intellectual property rights or these Terms.

Your Feedback must not violate another person’s copyright, trademark, privacy, personality, or other rights. It must not contain unlawful, abusive, or obscene material, viruses, or other malware.

You may not use a false email address, impersonate another person, or mislead us or others about the source of your Feedback.

You are responsible for your Feedback and its accuracy. We assume no responsibility or liability for Feedback posted by you or any third party.

12. Errors, Inaccuracies, and Omissions

We aim to get the details right. Occasionally, a typo escapes.

Information on the Services may contain errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, offers, shipping charges, transit times, or availability.

We reserve the right to correct these issues, update information, or cancel orders if information is inaccurate. We may do so at any time without prior notice, including after you submit an order.

13. Using the Services Responsibly

Please bring the same consideration you would bring to someone else’s home. Preferably without tracking mud through the website.

You may use the Services only for lawful purposes. You may not use them, directly or indirectly, to:

  • Violate applicable laws, regulations, or ordinances.

  • Infringe our intellectual property rights or anyone else’s.

  • Harass, abuse, insult, harm, defame, slander, disparage, or intimidate anyone.

  • Send, receive, upload, download, use, or reuse material that does not comply with these Terms.

  • Send or arrange unsolicited advertising, junk mail, chain letters, spam, or similar solicitations.

  • Restrict anyone else’s use or enjoyment of the Services.

  • Engage in conduct that, in our judgment, may harm Bappies, Shopify, or other users, or expose them to liability.

You also agree not to:

  • Upload or transmit viruses, malware, or other harmful code.

  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services.

  • Collect or track other people’s personal information.

  • Spam, phish, pharm, pretext, spider, crawl, or scrape.

  • Interfere with or bypass security features of the Services, other websites, or the internet.

If we determine that you have violated these Terms, we may suspend, disable, or terminate your account at any time without notice.

14. Ending Access

We may terminate this agreement or your access to all or part of the Services at our discretion, at any time and without notice.

You remain responsible for amounts due up to and including the termination date.

The provisions concerning intellectual property, Feedback, termination, warranty disclaimers, liability, indemnification, severability, waiver, the entire agreement, assignment, governing law, and privacy will continue to apply after termination, along with any other provisions that should survive by their nature.

15. Disclaimer of Warranties

The information provided through the Services is for general information purposes. We do not warrant its accuracy, completeness, or usefulness. You rely on it at your own risk.

We disclaim liability and responsibility arising from reliance on this information by you, other visitors, or anyone informed of its contents.

THIS INCLUDES IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR FREE FROM ERRORS.

SOME JURISDICTIONS LIMIT OR DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. THESE DISCLAIMERS MAY THEREFORE NOT APPLY TO YOU.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BAPPIES, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, AND LICENSORS, AND THOSE OF SHOPIFY AND ITS AFFILIATES, WILL NOT BE LIABLE FOR INJURY, LOSS, CLAIMS, OR DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS PURCHASED THROUGH THEM.

THIS INCLUDES LOST PROFITS, REVENUE, SAVINGS, OR DATA; REPLACEMENT COSTS; AND SIMILAR DAMAGES, WHETHER BASED ON CONTRACT, TORT INCLUDING NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE.

THIS LIMITATION ALSO APPLIES TO CLAIMS RELATED TO ERRORS OR OMISSIONS IN CONTENT, OR LOSS OR DAMAGE RESULTING FROM CONTENT OR PRODUCTS POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE THROUGH THE SERVICES, EVEN IF WE HAVE BEEN ADVISED THAT SUCH DAMAGES ARE POSSIBLE.

17. Indemnification

You agree to indemnify, defend, and hold harmless Bappies, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from losses, damages, liabilities, or claims payable to third parties, including reasonable attorneys’ fees, arising from:

  • Your breach of these Terms or the documents incorporated into them.

  • Your violation of any law or a third party’s rights.

  • Your access to or use of the Services.

We will notify you of claims covered by this section. A delay in notification will not relieve you of your obligations unless it materially prejudices you.

We may control the defense and settlement of a claim at your expense, including the choice of counsel. We will not settle a claim requiring nonmonetary obligations from you without your consent, which must not be unreasonably withheld.

You agree to cooperate in defending covered claims, including by providing relevant documents.

18. If Part of These Terms Cannot Be Enforced

If a provision is determined to be unlawful, void, or unenforceable, it will remain enforceable to the fullest extent permitted by law.

Any unenforceable portion will be treated as separate from these Terms. The remaining provisions will continue to be valid and enforceable.

19. Waiver and the Entire Agreement

If we do not exercise or enforce a right or provision under these Terms, that does not mean we waive it.

These Terms, together with the policies and operating rules we publish on this site or in connection with the Services, constitute the entire agreement between you and us and govern your use of the Services.

They replace prior or contemporaneous agreements, communications, and proposals, whether written or oral, including earlier versions of these Terms.

Any ambiguity in interpreting these Terms will not be construed against the party that drafted them.

20. Transferring Rights and Responsibilities

You may not delegate, transfer, or assign this agreement, or your rights or obligations under it, without our prior written consent. Any attempted transfer without that consent is null and void.

We may transfer, assign, or delegate these Terms and our rights and obligations without notice to you or your consent.

21. Governing Law and Courts

These Terms and any separate agreements through which we provide Services to you are governed by and interpreted under the laws of the jurisdiction where Bappies is headquartered.

You and Bappies consent to venue and personal jurisdiction in the federal, state, or territorial courts in that jurisdiction.

The headings help you find your way around. They do not limit or otherwise change the meaning of these Terms.

23. Changes to These Terms

You can find the current version of these Terms on this page.

We may update, change, or replace any part of these Terms at our discretion by posting the changes on our website. Please check this page periodically.

We will notify you of material changes as required by applicable law. Those changes will take effect on the date stated in the notice.

Your continued access to or use of the Services after changes are posted constitutes acceptance of the updated Terms.
